Version 1.0 · effective 15 October 2026

Terms of Service

These terms are a contract between Sylenze Ltd, a company registered in Scotland (company number SC845638, registered office 132 Strathcarron Drive, Paisley, PA2 7AY) ("Sylenze", "we", "us") and the organisation that creates a Sylenze Studio account ("you"). The person who signs up confirms they are 18 or over and have authority to accept these terms for the organisation. Sylenze Studio is for organisations such as schools, nurseries, clubs, charities and businesses, not for individuals acting for themselves.

1. The service

Sylenze Studio ("the Studio") replaces the faces in photos you upload with realistic, AI-generated fictional faces, so the photos can be used on your website and in your marketing. You can use it in a web browser or as an app added to your phone's home screen. Photos are processed and stored in the UK (Amazon Web Services, London). The original photo is deleted as soon as you accept the result. Everything else, including results you haven't downloaded, is deleted automatically 7 days after upload.

2. Your account

  1. You must give accurate details. Use an email address you use for your organisation; a personal address is fine for small clubs and groups.
  2. The person who signs up is the account Owner and is responsible for how the account is used. For now each organisation has one user.
  3. Keep your sign-in details secure and tell us at info@sylenze.com if you think your account has been misused.

3. Credits, plans and payment

  1. One credit processes one photo with up to 40 faces. Each further 40 faces uses one more credit. Photos where no faces are found are free, and so is a photo that fails to process. Up to 3 redos per photo are free.
  2. New organisations get 5 free credits. Free credits are given once per email domain for work email addresses, and once per email address for personal addresses such as Gmail or Outlook. We may withdraw free credits that have been obtained by getting round this rule.
  3. Plans (Essential and Expanded) are paid monthly or yearly. They renew automatically at the price then shown until you cancel. We'll email you at least 14 days before each yearly renewal. You can cancel or change plan at any time from Billing; the change takes effect at the end of the period already paid for, and there are no part-period refunds.
  4. Top-ups are one-off payments.
  5. You can pay by card, by Bacs Direct Debit, or by invoice. Invoices are due by the date shown on them. Credits are added once payment is received.
  6. If a photo needs more credits than you have, the result is kept but can't be downloaded until you add credits. It is still deleted 7 days after upload.
  7. Credits don't expire while your account is open, and are lost when it closes. They have no cash value and can't be transferred or refunded, except where these terms say so, where we have charged you in error, or where the law requires.
  8. Prices are in pounds sterling. Sylenze is not VAT registered, so no VAT is added. If that changes, we'll tell you before it affects any payment.
  9. Payments are taken by Stripe. We never see or store full card or bank details.

4. Your photos and your responsibilities

  1. You keep all rights in the photos you upload. You give us permission to process them only to provide the Studio to you.
  2. The results belong to you. To the extent we have any rights in a result or in the faces we generate, we transfer them to you. Generated faces are random and not copied from any real person, but we can't guarantee a face will never resemble someone.
  3. You are the data controller for the personal data in your photos. The Data Processing Agreement below forms part of these terms.
  4. You must have the right, and any permissions needed, to upload each photo, including your usual photo consent for children and parents.
  5. Before downloading, you must check every face in every result, including the background, and confirm in the Studio that you have done so. The Studio may miss faces that are small, partly hidden, blurred or side-on. A replaced face doesn't on its own stop someone being identified by their clothes, hair, name captions, location or other context.
  6. You decide whether and how to publish a result, and that decision is your responsibility.
  7. You must follow the Acceptable Use Policy below.

5. What we will and won't do with your photos

We won't use your photos or results to train AI models, sell them, or show them to anyone outside Sylenze and the sub-processors listed below. Sylenze staff don't look at your photos unless you ask us to help with a problem or we need to investigate a breach of the Acceptable Use Policy. We don't use face recognition: faces are located so they can be replaced, never matched to identities.

6. Availability and changes

We aim to keep the Studio available but don't promise it will always be uninterrupted or error-free. After a quiet spell, the first photo can take a few minutes while the engine starts. We may improve or change features. If a change significantly reduces what you've paid for, we'll tell you, and you may cancel and receive a refund of unused credits bought in the last 12 months.

7. Suspension and ending the agreement

  1. You can close your account at any time from Account in the Studio, or by contacting info@sylenze.com.
  2. We may suspend or close an account that breaches these terms or the Acceptable Use Policy, or doesn't pay. Where we reasonably can, we'll warn you first.
  3. When the account closes, any remaining photos are deleted 7 days after their upload as usual, and remaining credits are lost. We keep billing records and records of accepted terms as the law requires.

8. Liability

  1. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.
  2. We aren't liable for indirect or consequential loss, or for loss of profits, business, goodwill or reputation.
  3. We aren't responsible for how you use results, or for a face the Studio missed or changed poorly in a result you confirmed as checked and then downloaded. If a result is faulty, our responsibility is to redo it free or refund the credits used.
  4. Our total liability in any 12 months is limited to the greater of the amount you paid us in that period and £1,000.
  5. You'll compensate us for claims from third parties caused by your breach of clause 4 or the Acceptable Use Policy.

9. Changes to these terms

We may update these terms. We'll give Owners at least 30 days' notice of material changes by email and in the Studio, and the Owner will be asked to accept the new version before the next upload. If you don't agree, you can close your account and we'll refund unused credits bought in the last 12 months.

10. General

  1. These terms, the Data Processing Agreement and the Acceptable Use Policy are the whole agreement between us about the Studio.
  2. Neither of us is liable for delays caused by events outside our reasonable control.
  3. You may not transfer this agreement without our agreement. We may transfer it to a company that takes over the Studio, and will tell you if we do.
  4. If any part of these terms can't be enforced, the rest still applies. Nobody else has rights under these terms.
  5. We send notices by email to the Owner's address, or in the Studio. Send notices to info@sylenze.com.
  6. These terms are governed by Scots law, and the Scottish courts have exclusive jurisdiction.

Data Processing Agreement

This agreement forms part of the Terms of Service and meets the requirements of Article 28 of the UK GDPR. You (the organisation) are the controller of the personal data in the photos you upload; Sylenze is your processor.

1. Details of the processing

ItemDetail
Subject matterReplacing faces in photos uploaded to Sylenze Studio
DurationWhile the account is open. The original photo is deleted when the result is accepted; every photo and result is deleted automatically 7 days after upload
Nature and purposeStoring the photo, finding faces, generating replacement faces, returning the result to you
Personal dataPhotos of people, including faces and anything else visible in the image; the positions of faces in the image; file names
Data subjectsPeople in your photos, which may include children, pupils, parents, staff and members
Special category dataNot intended. Faces are located but never used to identify anyone, so no biometric identification takes place. Photos may incidentally reveal other details, such as religion or health
LocationUnited Kingdom (Amazon Web Services, London)

2. Our commitments

  1. We process the data only on your documented instructions, which are these terms and your use of the Studio, unless the law requires otherwise. We'll tell you if we think an instruction breaks data protection law.
  2. Everyone at Sylenze with access to the data is bound by confidentiality, and access is limited to named staff who need it.
  3. We keep the data secure, as set out in section 4.
  4. We use only the sub-processors listed below, under written contracts giving equivalent protection, and we remain responsible for them. We'll give you at least 30 days' notice of a new sub-processor that will handle your photos; if you reasonably object, you may close your account and receive a refund of unused credits.
  5. We help you respond to requests from people exercising their data protection rights. In practice, accepting a result deletes the original immediately, and everything is deleted 7 days after upload.
  6. We help you meet your duties on security, breach notification and data protection impact assessments.
  7. We tell you without undue delay, and within 48 hours, after becoming aware of a personal data breach affecting your data.
  8. We delete the original photo, and any earlier versions, as soon as you accept a result. Everything else is deleted automatically 7 days after upload, including at the end of the service. Because of how this works, we can't return photos at the end; download any results you need first.
  9. We give you the information you reasonably need to show compliance with Article 28, and allow reasonable audits on 30 days' notice, no more than once a year unless there has been a breach.
  10. We don't use your photos or results for any other purpose, including training AI models.

3. International transfers

Your photos are processed and stored only in the UK. Account and billing data may be handled by sub-processors outside the UK; where that happens, it is protected by UK adequacy regulations or a recognised safeguard such as the UK International Data Transfer Addendum or the UK–US data bridge.

4. Security measures

  • Photos are encrypted in transit (HTTPS) and at rest.
  • Storage can't be made public, and links to photos expire after 15 minutes.
  • Originals are deleted when a result is accepted; everything is deleted automatically 7 days after upload.
  • Photos uploaded but never sent for processing are deleted within 2 hours.
  • The processing server has no open ports and is reached only through AWS's managed access tools.
  • Camera metadata (EXIF), including location, device and time, is removed from results.
  • Each organisation can see only its own photos, enforced in the database.
  • Access to production systems is limited to named Sylenze staff.
  • The Studio app on phones never stores photos on the device.

Acceptable Use Policy

This policy applies to everyone using Sylenze Studio and forms part of the Terms of Service.

You must:

  • Only upload photos your organisation has the right to use, with the permissions your usual photo policy requires.
  • Check every result before you use it, including the background for small faces we may have missed.
  • Make clear, where it matters, that faces in published images have been changed. A short caption such as "Faces changed to protect privacy" is enough.

You must not:

  • Use the Studio, or its results, to deceive, impersonate, harass, bully or embarrass anyone.
  • Upload sexual, indecent or abusive images, or any inappropriate image of a child. We report illegal content to the police and the Internet Watch Foundation.
  • Use results to suggest that a real, identifiable person took part in something they didn't.
  • Try to reverse the face replacement or re-identify anyone in a result.
  • Upload photos taken without people's knowledge in private settings, or CCTV images.
  • Share your sign-in, resell the Studio, or try to get around credits, free-credit rules, limits or security.
  • Use the Studio to create images for political campaigning, or advertising that could mislead.

If you see a result that breaks this policy, tell us at info@sylenze.com. We may suspend accounts that break it.
